Right of Withdrawal
Right of withdrawal
Consumers within the meaning of Section 1 of the Consumer Protection Act (KSchG) have the right to withdraw from a contract concluded via distance selling without giving any reason. To do so, you must declare your withdrawal within fourteen working days of receipt of the goods. To meet this deadline, it is sufficient to send the notice of withdrawal within the specified period. The period begins upon receipt of this instruction in text form, but not before receipt of the goods (or, in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery).
Notice of revocation by returning the goods must be addressed to:
Dr. Ing. Franz Böhm GmbH
Webshop
Industriestraße 21
2325 Himberg, Österreich
The revocation may be made by email to office@drboehm.at or by letter to:
Dr. Ing. Franz Böhm GmbH
Webshop
Industriestraße 21
2325 Himberg, Österreich
Consequences of withdrawal
In the event of an effective revocation, the benefits received by both parties must be returned, and any derived benefits (e.g., interest) surrendered. If you are unable to return or surrender the received performance and benefits (e.g., benefits of use)—or can only do so in part or in a deteriorated condition—you must provide compensation for the value thereof. You are required to provide compensation for the deterioration of the goods and for derived benefits only if the use or deterioration is attributable to handling the goods in a manner that goes beyond examining their properties and functionality. “Examining the properties and functionality” is understood to mean testing and trying out the respective goods, such as is possible and customary in a retail store.
In the event of a withdrawal from the purchase contract, we shall reimburse all payments received from you, including delivery costs, no later than fourteen days from the day on which we receive notification of your withdrawal. We will use the same means of payment for this reimbursement as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is the earlier. The time limit begins for you upon dispatch of the notice of withdrawal or the goods, and for us upon receipt thereof.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the cancellation of the purchase contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods.
As soon as we receive the notice of cancellation or the returned goods, you will receive written confirmation via email.
Exclusion of the right of withdrawal
The right of withdrawal does not apply, among other things, to contracts for the supply of goods.
- which are manufactured according to customer specifications or are clearly tailored to personal needs;
- which, due to their nature, are not suitable for return;
- that are concluded with entrepreneurs or resellers.
